The general conditions of sale below refer to all items supplied by EmmeCi Klima Srl and form an integral part of every single document drawn up by the writer, as detailed in:

OFFERS

All offers drawn up by EmmeCi Klima Srl are valid for 10 working days, unless otherwise indicated.

ORDERS

All orders received by the writer must be complete and contain all the elements useful for the correct processing of the order confirmation.

Orders must refer to products in our catalog / price list. Any further request will be evaluated from time to time by EmmeCi Klima Srl in agreement with the customer.

Order confirmations are considered as accepted in their entirety by receiving null and void within 2 working days of receipt of the same.

Any change made to an order must be agreed in advance and formally with EmmeCi Klima Srl, otherwise the writer reserves the right to refuse such changes.

PRICES

The prices indicated on our price list are expressed in Euros net of the legal VAT in force at the time.All prices are intended ex works Santena wharehouse, unless previously agreed upon.Discounts and / or roundings are not accepted unless previously agreed.EmmeCi Klima Srl reserves the right to change the prices applied on the price list at any time, giving prior written notice to customers through conventional channels, such as: website, email, fax, registered mail.

DELIVERY TIME

The delivery times of all items supplied by EmmeCi Klima Srl, standard and non-standard, will be indicated every time on our order confirmation. In the event that the delivery date changes, Emmeci Klima Srl will be responsible for informing the customer and agreeing with the same a new delivery date or cancellation of the order, if no agreement is reached. Delivery times are not indicated on the offers, if not purely indicative.

However, EmmeCi Klima is not liable for delays in deliveries to customers for reasons not dependent on its organization (ex: delays caused by transport companies), as well as not responsible for delays due to force majeure (ex: catastrophic events such as earthquakes, floods, ….)

RETURN AND TRANSPORT

The goods are always considered delivered ex works Santena warehouse (TO).Any changes must be agreed in advance and represents a separate negotiation with each individual customer.The customer who pays for the transport has the right to directly appoint a transporter of his choice or he can ask the writer to take care of the transport by charging it, in this case, on the invoice.The customer who does not pay for the transport (delivered carriage paid) cannot choose the transporter. EmmeCi Klima Srl will contact companies affiliated with it depending on the distance, the type of transport and / or the urgency of delivery.

DISPUTES

We do not accept past claims after nr. 8 days from receipt of the supply.All complaints referring to the state of the goods and any shortages must be communicated by attaching appropriate supporting documentation.Returns of material are not accepted unless previously agreed.

TERMS OF PAYMENT

Payments must be made in accordance with the agreements entered into and reported on our order confirmation and on the invoice.In the event of a delay in payment, commercial interest will be applied to the extent of the official discount rate plus 5 percentage points.EmmeCi Klima Srl reserves the right of ownership of the goods until full payment of the invoice.

JURISDICTION

For any dispute the competent court is that of Turin (TO).
